As MK learned, the conflict arose in the summer of 2023, when Natalia Ukupnik rented out a townhouse and a garage. The tenant paid for the first and last months of her stay, but was forced to move out after just one month. Later, in a statement of claim, the woman listed all the shortcomings of the housing, and there were quite a few of them. The screens on the windows on the first floor were torn, and on the second and third floors, they were completely absent. The toilet seat in the bathroom on the third floor was broken, the closet door in the bedroom did not open, the electric stove was partially out of order, a leak was found in the bathroom on the second floor, the baseboard was broken, and some of the lights did not turn on. The composer's wife promised to fix all the shortcomings, but after two weeks, the work had not even begun. As a result, the woman decided to move out and demanded a refund for the last month - 300 thousand rubles. Since Natalia Ukupnik refused to do this, the dissatisfied tenant filed a lawsuit.
Initially, the Tverskoy Court sided with the artist's wife. The servants of Themis noted that the tenant had not initially reported the shortcomings of the townhouse, and when moving out of the apartment, the property transfer act was not executed, and the owner was not given the keys to the house. Moreover, the defendant did not agree to the early termination of the contract.
However, the Moscow City Court's appellate court decided otherwise. It noted that the notice of termination of the contract had been sent to Ukupnik in advance by e-mail, and she had agreed to accept the premises in response, but had not signed the deed on her own initiative. Therefore, in this case, all of the tenant's claims were justified. The court decided that Ukupnik's wife should return the deposit, plus interest. The second cassation court, where the woman tried to appeal the verdict, upheld the lower court's decision.
